Effective date: July 13, 2026. Please read these Terms carefully before using theaimart's website, marketplace, dashboard, APIs, and related services.
01Agreement and scope
These Terms and Conditions (“Terms”) form a binding agreement between you and theaimart (“theaimart”, “we”, “us”, or “our”) governing your access to and use of theaimart website, marketplace, developer dashboard, APIs, and related services (collectively, the “Service”). By accessing or using the Service, creating an account, publishing a listing, purchasing credits, or clicking an acceptance control, you agree to these Terms and our Privacy Policy.
If you use the Service for an organization, you represent that you are authorized to bind that organization. “You” includes that organization. If you do not agree, do not access or use the Service.
02Eligibility and accounts
You must be legally able to enter into this agreement and comply with the laws that apply to you. The Service is not directed to children under 13. If local law requires a higher minimum age or parental authorization, you may use the Service only when that requirement is met.
You must provide accurate, current account information; keep it updated; keep your credentials, authentication factors, and API keys confidential; and notify us promptly of suspected unauthorized access. You are responsible for activity under your account except to the extent caused by our failure to use reasonable safeguards.
One account, truthful identity
Do not create an account with false information, use another person's account without permission, or evade a suspension, usage limit, or payment obligation.
03Marketplace role
theaimart operates a platform that helps users discover, publish, distribute, and transact around AI apps, web apps, agents, models, and related software. Unless we expressly identify a product as provided by theaimart, listings are offered by independent developers or publishers.
We are not a party to the contract between you and an independent developer, do not control their products or data practices, and do not guarantee that a listing is safe, lawful, available, accurate, compatible, or fit for your purpose. Review the listing, its publisher, and any separate terms or privacy notice before installing, purchasing, or submitting data to it.
04Plans, payments and refunds
Prices, plan features, taxes, credit balances, renewal terms, and usage limits are presented at checkout or in the applicable order flow. You authorize the applicable payment provider to charge the selected payment method for all amounts due, including recurring charges where you choose a recurring plan. You must provide accurate payment and billing information and have authority to use the method submitted.
Payments may be processed by third parties, including Razorpay and PayPal where available. Their terms and privacy notices apply to their processing. A purchase is not complete until payment is authorized and confirmed. We may correct an obvious pricing or availability error, cancel an affected order, and refund any amount actually collected for that order.
Unless required otherwise by applicable law or an express written offer, digital credits, usage-based services, and subscriptions already consumed or accessed are non-refundable. You may request support for a defective charge or service at contact@theaimart.co; statutory cancellation, refund, and consumer rights are never excluded by this paragraph.
05Creators and publishers
If you submit a listing, app, agent, model, web app, release, or other developer material (“Developer Content”), you remain responsible for it. You represent and warrant that you have all necessary rights, permissions, licences, notices, consents, and lawful bases to publish it and to allow the uses described in these Terms.
You must provide accurate listing information; maintain a publicly accessible privacy notice where required; comply with applicable consumer, export-control, sanctions, intellectual-property, privacy, security, and AI laws; and promptly address security issues, takedown requests, and substantiated user complaints. You may not misrepresent affiliation, performance, pricing, data practices, certifications, or availability.
We may review, reject, remove, suspend, label, limit, or delist Developer Content when reasonably necessary to protect users, comply with law, enforce these Terms, address a rights claim, or preserve platform integrity. We do not undertake a duty to pre-screen every listing.
06API keys and developer tools
API keys, tokens, SDKs, webhooks, documentation, and developer tools are provided only for the account and permitted purpose for which they are issued. Do not expose a key in client-side code, a public repository, or an untrusted environment; share it outside your authorized organization; resell it; or use it to bypass quotas, billing, access controls, or safety measures.
You must promptly rotate or revoke a key you suspect is compromised. Usage measured through your credentials may be charged to your account, subject to investigation of reported unauthorized use. We may impose technical, rate, security, or operational limits and may modify or retire a non-versioned preview feature with reasonable notice where practical.
07Your content and licence
“Your Content” means information, files, prompts, code, feedback, reviews, listings, and other material you submit to the Service. You retain ownership of Your Content as between you and theaimart. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt solely for technical formatting, transmit, display, and otherwise use Your Content only as needed to operate, secure, improve, and provide the Service and to make public content available according to your chosen settings.
You grant other users the rights needed to access or use public Developer Content under the licence or terms you attach to it. You are solely responsible for selecting an appropriate licence and for the legality, accuracy, security, and appropriateness of Your Content.
08AI and third-party services
Features may use automated systems, AI models, model providers, payment processors, hosting providers, or other third-party services. Outputs can be inaccurate, incomplete, offensive, or unsuitable. You must review and independently validate outputs before relying on them, particularly for medical, legal, financial, employment, safety-critical, or other high-impact decisions.
Do not submit confidential, regulated, highly sensitive, or third-party personal information to an AI feature unless you are authorized to do so and the particular feature is suitable for that data. You are responsible for obtaining permissions and giving notices required for any inputs you submit. Third-party services are governed by their own terms and privacy notices.
09Intellectual property
The Service, including its software, interface, design, documentation, trademarks, and other materials provided by theaimart, is owned by or licensed to theaimart and protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, personal, revocable, non-transferable, non-sublicensable right to use the Service for its intended purpose.
You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, scrape, frame, or create derivative works from the Service except where law permits despite this restriction or we give prior written permission. If you send feedback, you grant us a perpetual, worldwide, irrevocable, royalty-free right to use it without restriction or compensation.
10Acceptable use
You must not, and must not help anyone else to:
- break applicable law; violate another person's rights; infringe intellectual property; or breach a contract, confidence, or privacy obligation;
- upload malware, attempt unauthorized access, disrupt the Service, probe or bypass security, introduce harmful code, scrape at a rate that harms the Service, or interfere with another user;
- use the Service to generate, distribute, or facilitate fraud, deceptive impersonation, spam, harassment, exploitation of minors, unlawful surveillance, or unlawful discriminatory activity;
- present AI-generated material as human-produced when disclosure is required, use AI outputs as the sole basis for a high-impact decision about a person, or facilitate self-harm, violence, or other serious harm;
- circumvent payment, credit, geographic, technical, account, or rate limits; manipulate reviews, downloads, rankings, referrals, attribution, or analytics; or use the Service to compete through unauthorized data extraction.
11Enforcement and reporting
We may investigate suspected violations, take action proportionate to the circumstances, and cooperate with competent authorities where legally required. Enforcement actions can include warnings, removal or restriction of content, reduced visibility, account or key suspension, cancellation of transactions, withholding of payouts where permitted, or termination.
To report suspected abuse, impersonation, illegal content, or an intellectual-property concern, email contact@theaimart.co with the relevant URL, a clear description, and any supporting information. We may ask for further details and will handle reports in accordance with applicable law and our operational processes.
12Availability and changes
We work to keep the Service available, but do not guarantee uninterrupted, error-free, secure, or compatible operation. Maintenance, third-party outages, security events, changes to providers, and circumstances outside our reasonable control can affect availability. Back up your important data and do not rely on the Service as your only record.
We may change, suspend, or discontinue all or part of the Service, including features, listings, APIs, and plans. For material paid-service changes, we will provide notice when reasonably practicable and required by law. We will not make a change that removes a mandatory consumer remedy.
13Disclaimers
To the maximum extent permitted by law, the Service and all content, listings, and AI outputs are provided “as is” and “as available.” theaimart disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability. We do not warrant that the Service will meet your needs or that defects will be corrected.
This does not exclude any warranty, guarantee, or consumer right that cannot lawfully be excluded or limited. Nothing in the Service is professional advice, and no output should be used as a substitute for qualified independent advice.
14Liability and indemnity
To the maximum extent permitted by law, theaimart and its affiliates, suppliers, and personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising from or related to the Service.
To the maximum extent permitted by law, our aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amounts you paid to theaimart for the Service giving rise to the claim in the 12 months before the event, or (b) USD 100. These limitations do not apply where prohibited by law, including liability that cannot legally be limited.
To the extent permitted by law, you will defend and indemnify theaimart against third-party claims, losses, and reasonable costs arising from Your Content, your Developer Content, your misuse of the Service, or your breach of these Terms. We will give you prompt notice of a claim and reasonable cooperation at your expense.
15Termination
You may stop using the Service at any time and may request account deletion through settings or the process in our Privacy Policy. We may suspend or terminate access when we reasonably believe you have violated these Terms, created risk for us or others, failed to pay amounts due, or where we must do so to comply with law.
Upon termination, your right to use the Service ends. Provisions that by their nature should survive—such as ownership, licences needed to operate previously published content, disclaimers, liability limits, indemnity, and dispute provisions—will survive. Termination does not affect accrued payment obligations or lawful data retention.
16Consumer rights and disputes
These Terms do not limit rights that cannot be waived under the law that applies to you, including mandatory consumer, privacy, or data-protection rights. If you have a concern, contact us first at contact@theaimart.co and provide sufficient detail to investigate. We will try to resolve it in good faith.
Where a governing law and forum may lawfully be selected, the laws and courts of the jurisdiction in which the theaimart contracting entity is established will apply, without regard to conflict-of-law rules. Mandatory law in your place of residence may still apply. The legal identity and registered address of the contracting entity will be provided in the applicable checkout, invoice, order form, or other legal notice.
17Changes and contact
We may revise these Terms to reflect changes to the Service, our practices, or applicable law. We will post the revised Terms and update the effective date. If a change is material, we will provide additional notice where required. Continued use after the effective date means you accept the revised Terms, except where law requires another form of consent.
If any provision is unenforceable, it will be modified only as necessary to make it enforceable and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, or sale of assets.
